Shane Warnke of Minnesota has decided he had enough of being pushed around and decided to seek redress through the web. But not without a forewarning, which ended on May 14, 2012.
Now, Warnke is approaching every news media outlet in the Midwest and is poised to release a video on YouTube to present what he sees as evidence of Bank of Americas negligence in processing his short sale request back in 2009. He also plans on lobbying at the Minnesota State Capitol to get supportive legislative action instilled to protect consumers from treatment such as this in the future.
Ive had enough. My case progressed up to the office of Bank of Americas CEO to review my complaints, only to be told that they had found no errors and therefore the foreclosure would remain, narrated Warnke, who is a Correctional Officer for the Minnesota Department of Justice and a Criminal Justice Major at St. Pauls Concordia University. This despite the proof of a botched short sale attempt caused by Bank of America's lack of cooperation and correspondence for nearly six months until the buyer finally walked out on the sale.
Luckily for Warnke, the realtors mitigation team kept detailed notes when they corresponded with Bank of America, including names and email addresses they contacted. Warnke presented these to the Bank who promised to compare these with their records. But Warnke doubts this will bear results considering the previous handling he got from the Bank of America.
"There comes a point when dealing with a company such as Bank of America, when they ran you in circles, where each person you deal with passes the buck onto someone else, till they wear you out," Warnke said. "I experienced this sort of service on various levels and departments within this company, and Ive got proof of that."
Warnke tells of a representative who shoved aside his evidence, claimed they committed no wrong doing. When Warnke asked if she realizes the mass litigation her company is under fire nationwide, the representative feigned unawareness.
"Well she must not own a television or read the newspaper then, Warnke jokingly said. But he was quick to add, There comes a point where these institutions must be held accountable for the mistakes they make while servicing loans. Im not asking for any sort of monetary settlement here, all I am asking them to do, is fix their mistake plain and simple as I just want to move on with my life.
He likened Bank of Americas surplus of houses to that of the neighborhood bully who had all the toys, but wouldnt let anyone else play with them.
Its as if they want to rub it in, that they have this huge surplus of homes that they own, but they arent going to let you buy one, because of the credit score you have, which in a lot of cases such as mine, was a result of their negligence, Warnke said.
